Last Will and Testament of John Lindars of Tetsworth

John Lindars died on 30th August 1773 at the age of 40 in Tetsworth, Oxfordshire and was buried in the church of St. Giles.   He was a Victualer and had apprenticed as a Cooper.

            In the name of God, Amen.  I John Lindars of Tetsworth in the county of Oxford, Victualer, being weak in body, but sound of mind and memory and understanding.   Do make, publish and declare thus my Last Will and Testament in manner and form following, that is to say, first, I desire all my just debts, funeral and testamonitary expenses be paid and discharge and after payment thereof I give devise and bequeath unto my son James Lindars all and singular my hoal and personal estates which I shall desire and ...................... of to hold untomy said son James Lindars, his heirs, executors, administrators and ................. subject never the less to the payment of several charges or sums of money hereinafter mentioned and also to say, I give and bequeath unto my daughter Elizabeth Lindars the sum of £50 of lawful money of Great Britain, to be   paid by the son James Lindars within twenty four months next my demise.  Any my will and desire is that my said daughter shall be at liberty to live with my son James until the marriage of either of them without paying or making any allowance for the same.

          I give and bequath unto my daughter Hester Lindars as soon as she attains the age of twenty one years the sum of £20 of lawful money.  Any my will and desire and I do hereby expressly order and direct my said son James to support cloath and educate my said daughter Hester until she attains 16 years.  Providing always and my will and meaning further is and it is my earnest request and desire that my said son James shall immidiatly after my decease   ................. my wife out of doors only letting her have her wearing apparel and what the law will give her, but if my said son James .......... thereafter letts my said wife have a living with him or makes any kind or provision whatever for her.    Then and in either of these cases I do hereby revoke and make void the gift, demise and bequest of my soal and personal estate so as aforsaid unto my said son James given demised and bequeathed.

          And in his place hearby only give him one shilling and then I do hereby give, demise and bequeath and siad soal and personal estate unto my said daughter Elizabeth, for her heirs administrators and ........... for ever, subject to the payment of the aforsaid £20 and maintenance of my said daughter Hester in the same manner before, divided to be paided dowry by my son James.

          And I do hereby nominate constitute and appoint my son James Lindars executor of this my Last Will and Testament.   Hereby revoking any former Wills by me at any time heretofore made and do declare only to be my last.

          In witness whereof I have to this my Last Will and Testament containes in one sheet of paper sett my hand and seal this first day of September in the year of our Lord one thounsand seven hundred and seventy three.

          Signed sealed and published by the said John Lidars the testator as and for last will and Testament in the presence of us who at his request and in his provenance and in sight of each other have subscribed our names as witnesse.

Proved the 30th day of August before the Reveren William Stocking, Clerk Surrogate by the Hand of James Lindars natural and lawful son and sole executor to whom was committed he being first sworn duly to adminstrator.

 
   

 

 

 

 
 

This will is on record at the Oxfordshire County Record Office, on parchment and was copied in 1990.  The spellings are taken directly from the manuscript.   A transcript of the will was kindly provided by Gordon Lindars.
